In the immigration process, the dependent’s age and marriage status are the most important deciding factors.
- In Immigration law, “child” means unmarried and under 21.
- Any child over 21 or married is classified as an “adult son or daughter”.
If you’re a U.S. citizen, you may sponsor:
- unmarried children under 21
- unmarried adult children 21 or order — their own children may also be included
- married adult children of any age – their spouse and children may also be included
If you’re a permanent resident (green card holder), you may sponsor:
- unmarried children under 21 — their own children may alsobe included
- unmarried adult children (21 or older) – their own childrenmay also be included

- Only U.S. citizens age 21 or older may sponsor their parents for green cards; parents are considered immediate relatives, so there is no priority date wait
- Permanent residents (green card holders) cannot sponsor their parents
